lots of questions regarding CMV’s and parking on your street, I’ll try my best to answer all of these, sorry for the long reply in advance.
a) Are commercial vehicle allowed to park on the road in a residential area?
Answer – Yes, they are allowed to park on the road in a residential area, as long as the commercial motor vehicle does not reach the weight limit that defines the commercial motor vehicle as a “Heavy Vehicle” (defined below)
“Heavy Vehicle” means a commercial motor vehicle having a registered gross vehicle
weight in excess of six thousand kilograms (6 tonnes) but excludes fire apparatus,
emergency vehicles, buses and road service vehicles;
b) If so, what is the allowed height to this commercial vehicle.
Answer – There is no height limit for the commercial vehicle with respect to parking – as defined above the regulation surrounding commercial vehicles and parking residentially surrounds their weight.
c) Also, how far back should it be from my driveway?
Answer – By-Law Number 245-2004 of the Corporation of the Municipality of Chatham-Kent section 210.01.11 states
Parking Prohibited – Specified Places, Without Signs
210.01 Subject to the previous Sections of Part II, no person shall park a vehicle or permit a
vehicle to remain parked on any highway:
– opposite, in front of or within one-half metre (0.5 m) of a driveway or laneway or
a curb-cut or depressed curb thereto, or in such a position so as obstruct
vehicle(s) in the use of any driveway or laneway;
d) Also, are commercial tow trucks allowed to park in residential area?
Answer – Yes, as long as they fall below the weight restriction I listed above they are allowed to park on the roadway.
